温室气体自愿减排机制法律问题研究”开题会暨学术研讨会成功举办
Opening Session and Academic Seminar of "Research on Legal Issues of Voluntary Mechanism of Greenhouse Gas Emission Reduction" Successfully Held
由文法学部法律系谭柏平老师承担的课题“温室气体自愿减排机制法律问题研究”开题会暨学术研讨会，于2021年11月17日上午以线上会议的方式成功举行。本课题的主要目标是深入研究温室气体自愿减排机制相关法律问题，进一步优化自愿减排交易管理方式，并给生态环境部部门规章《温室气体自愿减排交易管理办法（试行）》的制定提供法律支持。会议由北京工业大学法律系承办。
On the morning of November 17, 2021, the opening session and academic seminar of "Research on Legal Issues of Voluntary Mechanism of Greenhouse Gas Emission Reduction" undertaken by Tan Baiping, a faculty member from the College of Law, Faculty of Humanities and Social Sciences, was successfully held online. This project is mainly designed to deeply study the legal issues related to the voluntary mechanism of greenhouse gases emission reduction, further optimize the management mode of voluntary emission reduction trading, and provide legal support for the formulation of Regulation of Voluntary Greenhouse Gases Emission Reduction trading (Trial), the regulation of the Ministry of Ecology and Environment. The meeting was organized by the Department of Law of BJUT.
来自生态环境部气候司、国家气候战略中心、生态环境部环境发展中心、中国人民大学、清华大学、对外经济贸易大学、首都经济贸易大学、首都师范大学、中国农业大学、北京绿色交易所的领导和专家学者应邀参加了会议。会议分为开题会与研讨会两个议程。
Leaders, experts and scholars from the Climate Department of Ministry of Ecology and Environment, National Center for Climate Change Strategy and International Cooperation, Environmental Development Center of Ministry of Ecology and Environment, Renmin University of China, Tsinghua University, University of International Business and Economics, Capital University of Economics and Business, Capital Normal University, China Agricultural University and Beijing Green Exchange were invited to attend the meeting. The meeting consists of opening session and seminar.
开题会由中国人民大学法学院周珂教授主持，生态环境部气候司领导致辞。课题负责人谭柏平老师做了开题汇报。经过专家质询与讨论，形成了开题意见。专家组认为，本课题的开题设计总体上研究目标明确，研究内容全面，研究途径可行，研究方法合理，可以满足课题研究任务书的要求，一致通过了开题验收。
The opening session was presided over by Professor Zhou Ke from Law School of Renmin University of China, and the leaders of Climate Department of Ministry of Ecology and Environment delivered speeches. Tan Baiping, the person in charge of the topic, gave an opening report. The opening opinions were formed according to expert inquiry and discussion. The expert group believes that the opening design of this project ensures the clear research objectives, comprehensive research contents, feasible research approaches and reasonable research methods, as well as the compliance with the requirements of the research order. Therefore, expert group approved the opening acceptance unanimously.
第二个议程为研讨环节，由谭柏平老师主持。与会专家学者围绕“温室气体自愿减排机制法律问题研究”的内容框架，展开了讨论。重点探讨了在“双碳”目标下CCER管理模式，自愿减排项目的唯一性与额外性，自愿减排项目的范围如何界定，为保证自愿减排项目质量和CCER的同质性，相关法律制度如何完善，包括专家委员会、信息披露、失信惩戒、举报受理和奖励等，在CCER管理办法的条款中如何规定相应法律责任，中央和地方对CCER的监管职责如何分工，如何加强自愿减排交易活动的事中事后监管等。讨论气氛热烈，会议取得圆满成功。
The second agenda is a seminar, which is presided over by Tan Baiping. The participating experts and scholars had a discussion around the framework of "Research on Legal Issues of Voluntary Mechanism of Greenhouse Gas Emission Reduction". The topics which were focused on include the CCER management mode under the goal of "carbon peaking and carbon neutrality", uniqueness and additionality of voluntary emission reduction project, how to define the scope of voluntary emission reduction project, how to improve the relevant legal system so as to ensure the quality of voluntary emission reduction project and the homogeneity of CCER, including the expert committee, information disclosure, disciplinary action for dishonesty, acceptance and reward of reports, how to stipulate corresponding legal responsibilities in the provisions of CCER regulation, how to divide the supervision responsibilities of CCER between the central and local governments, and how to strengthen the in-process and post-process supervision of voluntary emission reduction trading. The meeting got a complete success with the warm academic discussion atmosphere.
法律系主任谭柏平老师承担生态环境部“自愿减排交易管理方式优化”科研项目结题后，提交了一份高质量的《温室气体自愿减排交易管理办法（试行）》专家建议稿及其编制说明，已经有了丰富的学术积累。然而，该管理办法中仍有许多法律问题需要深入探究，“温室气体自愿减排机制法律问题研究”课题设计的主要目标，便是为出台《温室气体自愿减排交易管理办法（试行）》持续提供法律支持，并深耕其中的法律理论。
Tan Baiping, Head of the College of Law, submitted a high-quality expert proposal, Regulation of Voluntary Greenhouse Gases Emission Reduction trading (Trial) and its compilation instructions after completing the scientific research project "Optimization of Management Mode for Voluntary Emission Reduction Trading" of the Ministry of Ecology and Environment, with the rich academic accumulation. However, there are still many legal issues in this management method in need of deep exploration. "Research on Legal Issues of Voluntary Mechanism of Greenhouse Gas Emission Reduction" is designed in such a manner to continuously provide legal support for the promulgation of the Regulation of Voluntary Greenhouse Gases Emission Reduction trading (Trial) and deeply explore the related legal theory.
