“温室气体自愿减排机制法律问题研究” 中期验收会暨学术研讨会成功举办
The Mid-term Acceptance Meeting and Academic Seminar of "Research on Legal Issues of Voluntary Greenhouse Gas Emission Reduction Mechanism" Successfully Held
文法学部法律系谭柏平老师承担的课题“温室气体自愿减排机制法律问题研究”中期验收会暨学术研讨会，于2022年7月14日上午以线上会议的方式成功举行。本课题的主要目标是深入研究“双碳目标”背景下温室气体自愿减排机制相关的法律问题，进一步优化自愿减排交易管理方式，并给生态环境部部门规章《温室气体自愿减排交易管理办法（试行）》的制定，持续提供法律支持。会议由北京工业大学法律系承办。
The mid-term acceptance meeting and academic seminar on the topic "Research on Legal Issues of Voluntary Greenhouse Gas Emission Reduction Mechanism" researched by Tan Baiping, a teacher of the Department of Law of the Faculty of Humanities and Social Sciences, was successfully held on the morning of July 14, 2022, in the form of an online meeting. The main objective of this topic is to deeply study the legal issues related to the voluntary emission reduction mechanism of greenhouse gases under the background of achieving the "carbon peaking and carbon neutrality" goals, further optimize the management mode of voluntary emission reduction transactions, and continue to provide legal support for the formulation of the Measures for the Administration of Voluntary Greenhouse Gas Emission Reduction Trading (Trial), a departmental regulation of the Ministry of Ecology and Environment of the People’s Republic of China. The meeting was organized by the Department of Law of BJUT.
来自生态环境部气候司、国家应对气候变化战略研究中心、北京市法学会环境法学研究会、EDF美国环保协会、北京信用学会、中国人民大学、清华大学、首都经济贸易大学、首都师范大学的领导和专家学者应邀参加了会议。会议议程分为中期验收会与研讨会两个环节。
Leaders, experts and scholars from the Department of Climate Change of the Ministry of Ecology and Environment of the People’s Republic of China, the National Center for Climate Change Strategy and International Cooperation (NCSC), the Environmental Law Research Society of the Beijing Law Society, the Environmental Defense Fund (EDF), the Beijing Credit Society, Renmin University of China, Tsinghua University, the Capital University of Economics and Business, and the Capital Normal University were invited to attend the meeting. The agenda of the meeting is divided into two parts including mid-term acceptance meeting and seminar.
中期验收会由中国人民大学法学院周珂教授主持，生态环境部气候司领导致辞。课题负责人谭柏平老师做了中期验收汇报。经过专家质询与讨论，形成了中期考核评审意见。专家组认为，课题组能够按照合同约定的项目实施进度开展研究，研究途径清晰，研究方法适当，取得了有价值的研究成果，符合课题研究任务的要求，一致通过了中期验收。
The mid-term acceptance meeting was presided over by Professor Zhou Ke of the Law School of Renmin University of China, and the leader of the Department of Climate Change of the Ministry of Ecology and Environment of the People’s Republic of China delivered a speech. The project leader Tan Baiping made a mid-term acceptance report. After experts' inquiry and discussion, the mid-term assessment review opinions were made. The expert group approved that the research team was able to carry out research according to the project implementation schedule agreed upon in the contract, adopted a clear research approach and appropriate research method, and achieved valuable research results, which met the requirements of the research task of the project. The mid-term acceptance was unanimously passed.
在研讨环节，与会专家学者围绕“温室气体自愿减排机制法律问题研究”的内容框架，展开了深入讨论。重点探讨了在“双碳”愿景目标及“放管服”改革背景下国家核证减排量（即CCER）的事前事中监管、CCER数据造假的法律责任、专家评估中不良行为的惩戒措施、自愿减排交易机制与类似减排机制的厘清、如何避免减排量的重复计算，以及与CCER管理办法配套的制度建设等问题。讨论气氛热烈，会议取得圆满成功。
During the discussion, experts and scholars who attended the meeting made in-depth discussions on the content framework of the "Research on Legal Issues of Voluntary Greenhouse Gas Emission Reduction Mechanism". The discussions focused on the issues of proactive and in-process regulation and supervision of China Certified Emission Reduction (CCER) under the reform background to achieve the goal of "carbon peaking and carbon neutrality" and to "streamline administration and delegate power, improve regulation, and upgrade services”, the legal responsibility of CCER data fraud, disciplinary measures for bad behavior in expert assessment, the clarification of voluntary emission reduction trading mechanism and similar emission reduction mechanisms, the methods to avoid double counting of emission reductions, and the system construction supporting the CCER management measures. The meeting got a complete success with the warm academic discussion atmosphere.
法律系主任谭柏平老师承担生态环境部“自愿减排交易管理方式优化”科研项目，执笔起草了部门规章《温室气体自愿减排交易管理办法（试行）》专家建议稿及其编制说明，经过不断研讨与调研，该部门规章历经20余稿，草案日臻成熟。前期课题结题后，CCER相关问题仍余有许多法律难题需要深入探究，“温室气体自愿减排机制法律问题研究”课题设计的主要目标，便是为《温室气体自愿减排交易管理办法（试行）》的出台持续提供法律支持，并深耕其中的法律理论问题。
Tan Baiping, director of the Department of Law of BJUT, undertook the scientific research project of the Ministry of Ecology and Environment of the People's Republic of China on "Optimization of Management Mode of Voluntary Emission Reduction Trading", and drafted the expert proposal draft and its preparation instructions of the "Measures for the Administration of Voluntary Greenhouse Gas Emission Reduction Trading (Trial)". After constant discussion and research, the regulation has more than 20 drafts, and the draft has become a perfect one finally. After the conclusion of the previous project, there are still many legal problems related to CCER that need to be researched in depth. The main goal of the project design of "Research on Legal Issues of Voluntary Greenhouse Gas Emission Reduction Mechanism" is to provide legal support for the issuance of the "Measures for the Administration of Voluntary Greenhouse Gas Emission Reduction Trading (Trial)", and to deeply study the related legal theoretical issues.
